Alias Payments, Inc. ("us", "we", or "our") operates the www.pumafastpay.com website and the Puma Fast Pay mobile application (the "Service").

This page informs you of our policies regarding the collection, use and disclosure of Personal Information when you use our Service. This Privacy Policy governs your experience while availing yourself of the Services. We will not use or share your information with anyone except as described in this Privacy Policy.

In case of any conflict between the contents of this English version and the Spanish version, you accept and acknowledge that this English version is the original and shall prevail. This Privacy Policy is effective as of September 1, 2016 and will remain in effect except with respect to any changes in its provisions in the future, which will be in effect immediately after being posted on this page.

We reserve the right to update or change our Privacy Policy at any time and you should check this Privacy Policy periodically. Your continued use of the Service after we post any modifications to the Privacy Policy on this page will constitute your acknowledgment of the modifications and your consent to abide and be bound by the modified Privacy Policy.

Information Collection and Use

While using our Services, we may ask you to provide us with certain personally identifiable information that can be used to contact or identify you. Personally identifiable information means any information by which you can be identified or contacted and may include, but is not limited to, your email address, name, phone number, postal address, and other similar information ("Personal Information").

We collect this information for the purpose of providing the Service, identifying and communicating with you, responding to your requests/inquiries, servicing your purchases, and improving our services.

We may employ third party companies and individuals to facilitate our Service, to provide the Service on our behalf, to perform Service-related services and/or to assist us in analyzing how our Service is used. To best serve you, we may share your personal information with service providers that provide support services to us or that helps us administer or provide our Services. Service providers, third parties who may perform services directly related to the APP and the Services on our behalf, are restricted from disclosing or using your information in any manner other than in helping us to provide you with the Services.

Financial Information

The App enables you to use and pay for the automated fuel dispenser services at Puma brand fuel stations. If you wish to avail yourself of the Services and purchase gasoline through the App you will be asked to supply certain information relevant to your being able to proceed with your Purchases, this includes, without limitation, your credit or debit card number, the expiration date of your credit or debit card, security code and your billing address. Your credit or debit card information is tokenized and stored using a PCI Level 1 3rd party provider, For this process, we ask for your first name, last name, card number, card expiration date, card verification value (CVV), and the billing zip code. This information is validated and automatically stored in the vault. WE DO NOT HAVE ACCESS AT ANY TIME TO YOUR CREDIT OR DEBIT CARD NUMBERS, OR TO YOUR CVV INFORMATION. To activate your debit or credit card you must verify the same. For purposes of card verification, we make two small random amount debits which you must confirm by checking your card statement and entering the amounts on the App.

We do not share with Puma at any time any of the information you provide related to your credit and/or debit card (the “financial information”) nor the related encrypted tokens.

Log Data

We may also collect information that your browser sends whenever you visit our Service or when you access the Service by or through a mobile device ("Log Data").

This Log Data may include information such as your computer's Internet Protocol ("IP") address, browser type, browser version, the pages of our Service that you visit, the time and date of your visit, the time spent on those pages and other statistics.

When you access the Service by or through a mobile device, this Log Data may include information such as the type of mobile device you use, your mobile device unique ID, the IP address of your mobile device, your mobile operating system, the type of mobile Internet browser you use and other statistics.

In addition, we may use third party services such as Google Analytics that collect, monitor and analyze this type of information in order to increase our Service's functionality. These third party service providers have their own privacy policies addressing how they use such information.

Location Information

We may use and store information about your location depending on the permissions you have set on your device. We use this information to provide features of our Service, and to improve and customize our Service. You can enable or disable location services when you use our Service at any time, through your mobile device settings.

Cookies are files with a small amount of data, which may include an anonymous unique identifier. Cookies are sent to your browser from a web site and transferred to your device. We use cookies to collect information in order to improve our services for you.

We will disclose your Personal Information where required to do so by law or subpoena or if we believe that such action is necessary to comply with the law and the reasonable requests of law enforcement or to protect the security or integrity of our Service.

Business Transaction

If Alias Payments, Inc. is involved in a merger, acquisition or asset sale, your Personal Information may be transferred as a business asset. In such cases, we will provide notice before your Personal Information is transferred and/or becomes subject to a different Privacy Policy.

The security of your Personal Information is important to us, and we strive to implement and maintain reasonable, commercially acceptable security procedures and practices appropriate to the nature of the information we store, in order to protect it from unauthorized access, destruction, use, modification, or disclosure.

However, please be aware that no method of transmission over the internet, or method of electronic storage is 100% secure and we are unable to guarantee the absolute security of the Personal Information we have collected from you.

International Transfer

Your information, including Personal Information, may be transferred to — and maintained on — computers located outside of Puerto Rico where the data protection laws may be different than those from your jurisdiction.

If you are located anywhere outside of the United States and choose to provide information to us, please note that we transfer the information, including Personal Information, to the United States and process it there.

Children's Privacy

Only persons age eighteen (18) or older have permission to access our Service. More specifically, our Service is not intended for use by anyone under the age of eighteen (18) ("Children").

We do not knowingly collect personally identifiable information from children under 13. If you are a parent or guardian and you learn that your Children have provided us with Personal Information, please contact us immediately by way of the contact information provided below. If we become aware that we have collected Personal Information from Children without verification of parental consent, we will take steps to remove that information from our servers immediately.

Remove / Delete your information

The app allows you to remove / delete your account and all of your personal data and transaction history. We will delete all the data that can identify yourself, such as email, telephone number, geolocation, payment methods, etc.

Once agreed to delete your account, this process will take place immediately and cannot be undone. If you want to use this app later on again, you will need to create a new account in which you will not have access to the deleted data.

THIS OPERATION IS IRREVERSIBLE. IF YOU DELETE YOUR ACCOUNT, WE WILL NOT BE ABLE TO RECOVER IT FOR YOU.

Users should contact third-party services directly to delete their data if it is used by the app.

Limitation of Liability

In no event shall Alias Payments, Inc., Puma Energy Caribe, LLC, nor their directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose. Each party irrevocably waives to the fullest extent permitted by applicable law its rights to trial by jury in any action or proceeding arising out of or relating to this Privacy Policy, or any transaction relating to its subject matter, including, but not limited to, your use of the services.

Governing Law

This Privacy Policy shall be governed and construed in accordance with the laws of The Commonwealth of Puerto Rico, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of this Privacy Policy will not be considered a waiver of those rights. If any provision of this Privacy Policy is held to be invalid or unenforceable by a court, the remaining provisions of this Privacy Policy will remain in effect. If we do waive a default by you, we will only do so in writing, and that will not mean that we will automatically waive any later default by you.

Each of the provisions of this Privacy Policy operates separately. If any court of competent authority decides that any of them are unlawful or unenforceable, the remaining provisions will remain in full force and effect.
